Entry Conditions

Participation

  1. This competition (“Competition”) is conducted by Mars Australia Pty Ltd, ABN 48 008 454 313, trading as Mars Petcare Australia, of 1 Petcare Place, Wodonga VIC 3690 (“Promoter”).
  2. Entry to the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
  3. The Competition is only open to Eligible Entrants. An “Eligible Entrant” is an individual who: (i) is a resident of Australia aged 18 years, or older, as at the time of entry; and (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
  4. Entry opens at 9am on 17/5/10 and closes at 5pm on 19/7/10 (“Entry Period”). All times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date.

Entry

  1. To enter, an Eligible Entrant must, during the Overall Entry Period, purchase one pack of SCHMACKOS Popcorn or SCHMACKOS STRAPZ (any size) (each a “Promotion Product”) from any retail outlet anywhere in Australia.
  2. Subject to the other conditions, an Eligible Entrant may enter the Competition once for every Promotion Product that they so purchase.
  3. Entry can only be made by internet. To submit an entry, an entrant must use a compatible browser to visit www.wheresroger.com.au (“Competition Website”) and follow the directions there. For each entry, the entrant must provide: (a) his/her answer to the competition question asked (the “Competition Question”); (b) the requested details from the bar code on the Promotion Product being used to enter; and (c) all other details required at the Competition Website, including first and last names, postal address and e-mail address.
  4. On any one day: (i) an Eligible Entrant may submit no more than one entry; and (ii) no more than one entry will be accepted containing the same e-mail address.
  5. Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
  6. Eligible Entrants must make their internet entries manually using an internet browser. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service
  7. All entrants must ensure that their entries are received by the Promoter during the Overall Entry Period. The Promoter takes no responsibility for any late or misdirected entries or for any delays or failures in any telecommunications service or equipment.
  8. For each and every Promotion Product an entrant uses to submit an entry, he/she MUST retain: (i) the bar code panel from the Promotion Product; and (ii) the receipt (or a photocopy of it) from the purchase of the Promotion Product that: (a) is issued during the Entry Period by the retail outlet from which the Promotion Product was purchased; and (b) identifies the Promotion Product as an item purchased.
  9. All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition.
    1. An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means determined by the Promoter) all of the items which condition 12 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.
    2. An entrant MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
  10. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's reasonable satisfaction; or (ii) fails to produce items as required by condition 13 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, submits an entry which is not in accordance with these conditions.
  11. An entry by more than one person (ie a joint entry) is invalid.

Prize Draw and Prizes

  1. The prize will be held at noon on 23/7/10 at Suite 205, 22 Mountain St, Ultimo NSW 2007.
  2. Subject to these conditions:
    1. the Eligible Entrant who submitted the first valid entry drawn that includes the correct answer to the Competition Question will win $250,000 (the “Major Prize”); and
    2. the Eligible Entrants who submitted the first 400 valid entries drawn (whether or not the entry includes the correct answer to the Competition Question, but excluding the first valid entry drawn that includes the correct answer to the Competition Question) will each win one Double Movie Pass, valued at $34.
  3. The Major Prize will be paid by means of a crossed cheque payable to the winner, or if the winner so requests, by means of electronic transfer of funds to any nominated account in Australia.
  4. Each Double Movie Pass prize will be awarded as a two “Admit 1” Screen Saver Vouchers, together valued at $34. Each Screen Saver Voucher is issued by The Greater Union Organisation Pty Ltd (“Greater Union”) subject to such conditions as may be imposed by Greater Union from time to time (“Greater Union Conditions”). The Greater Union Conditions include conditions that a Screen Saver Voucher: (i) does not guarantee a reserved seat - seating is subject to availability; (ii) expires on the expiry date shown on the face of the Voucher; (iii) entitles the holder (subject to the Greater Union Conditions) to one adult or student admission to any standard session at any Event Cinemas, Greater Union, Birch Carroll & Coyle, or Village Cinema; and (iv) is not valid for any screening from 5pm on a Saturday, or for any Silver Screen, Gold Class or Europa cinemas, Movie Marathons or any other special screenings.

Prizes Generally

  1. The maximum total value of all prizes is $263,600.
  2. Each prize is valued as at 8/4/10. The Promoter takes no responsibility for any variations in value of a prize.
  3. If a Double Movie Pass prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a Double Movie Pass prize is unavailable for any reason.
  4. A right to receive a prize is not transferable or exchangeable and except for the Major Prize, cannot be taken as a monetary payment.
  5. Unless expressly stated in these conditions, all expenses incurred in relation to enjoyment of a prize are the responsibility of the winner.

Winners

  1. Each winner will be notified in writing sent by e-mail to the e-mail address indicated in the entry. The notification may include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
  2. The name of the Major Prize Winner will be published in The Australian on 29/7/10.
  3. The name of the Major Prize Winner may also be published at www.wheresroger.com.au within 7 days of the Major Prize being won (including in a redraw under condition 28), for a period of at least 1 week.
  4. Subject, where relevant, to any directions given under the legislation regulating the Competition, if a prize is not claimed by a winner the prize will be awarded to another Eligible Entrant in a redraw for that prize commencing at 3pm on 9/11/10 at Suite 205, 22 Mountain St, Ultimo NSW 2007. If the Major Prize is awarded in such a redraw, the name of the Major Prize winner in the redraw will be published in The Australian on 22/11/10.
  5. In order to be entitled to any prize, the winner must, if requested by the Promoter, agree to and sign:
    1. an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize and/or participate in the prize; and
    2. a liability release, waiver and/or indemnity in favour of the Promoter and/or any person or other entity associated with this Competition.
  6. A winner will forfeit his/her prize if he/she fails to ensure that all documents relating to that prize (or participation in that prize) are signed in accordance with this condition, as and when required by the Promoter.

General

  1. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
  2. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
  3. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
  4. All of the Promoter's decisions are final and no correspondence will be entered into.
  5. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.
  6. To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the “Relevant Parties”) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death.
  7. If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
  8. The Major Prize winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
  9. Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winners and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
